Accommodation Terms & Conditions

These Accommodation Terms & Conditions (“Terms”) apply to all bookings and stays at The Gibraltar Bowral (“Hotel”). 


1. Application of Terms 

  1. These Terms govern all accommodation agreements between the Hotel and guests. 
  2. The person making the booking warrants that they have authority to accept these Terms on behalf of all guests included in the booking. 
  3. Any special terms stated in a booking confirmation, rate plan, group agreement, or package description form part of these Terms and prevail to the extent of any inconsistency. 
  4. Nothing in these Terms excludes, restricts, or modifies any rights or remedies available under the Australian Consumer Law (“ACL”). 

2. Bookings & Confirmation 

  1. All bookings are subject to availability and confirmation by the Hotel. 
  2. A booking is confirmed only once the Hotel issues a confirmation number or written confirmation. 
  3. The Hotel reserves the right to cancel or amend bookings affected by obvious pricing or system errors, with a full refund of amounts paid. 

3. Check-In, Check-Out & Occupancy 

  1. Check-in: from 2:00pm. 
  2. Check-out: by 10:00am. 
  3. Early check-in and late check-out are subject to availability and may incur additional charges. 
  4. Guests must vacate rooms by check-out time unless expressly agreed. 
  5. Maximum room occupancy limits apply. Exceeding occupancy limits constitutes a material breach of these Terms. 

4. Identification & Age Requirements 

  1. Valid government-issued photo identification may be required at check-in. 
  2. Guests under 18 years of age must be accompanied by a responsible adult unless approved in writing by the Hotel prior to arrival. 
  3. The Hotel may refuse check-in where satisfactory identification is not provided. 

5. Rates, Payments & Security 

  1. All rates are quoted in Australian Dollars (AUD) and include GST unless stated otherwise. 
  2. Payment timing depends on the booked rate: 
    • Flexible rates: payable prior to or at check-in. 
    • Advance purchase / non-refundable rates: payable in full at time of booking. 
  3. The Hotel may require a credit card pre-authorisation or security bond at check-in to cover incidentals, damages, excessive cleaning, or unpaid charges. 
  4. Any unused pre-authorised amount will be released following departure, subject to banking timeframes. 
  5. Credit card surcharges may apply and will be disclosed prior to payment. 

6. Cancellations, Amendments & No-Shows 

  1. Cancellation and amendment conditions are those stated in the booking confirmation or applicable rate plan. 
  2. Where no specific policy applies, the Hotel’s standard policy applies: 
    • Free cancellation up to 48 hours prior to arrival. 
    • Late cancellation or no-show may incur a charge of up to one night’s accommodation. 
  3. Failure to arrive by 8:00pm on the day of arrival without prior notice may be treated as a no-show. 
  4. Early departures may be charged in accordance with the booked rate conditions. 

7. Guest Conduct & Termination 

  1. Guests must comply with all reasonable Hotel rules, policies, and directions. 
  2. Behaviour that is unlawful, unsafe, disruptive, abusive, or causes damage or unreasonable disturbance is prohibited. 
  3. The Hotel may terminate accommodation and require guests to vacate immediately in the event of serious breach, including non-payment, safety risks, excessive noise, or property damage. 
  4. Charges for accommodation provided, damages, cleaning, and losses remain payable following termination. 

8. Smoking Policy 

  1. The Hotel is a non-smoking property. 
  2. Smoking or vaping in guest rooms or indoor areas is strictly prohibited. 
  3. Where this policy is breached, the Hotel may charge reasonable cleaning, deodorisation, and loss-of-revenue costs. 

9. Damage, Cleaning & Incidentals 

  1. The registered guest is responsible for any damage, missing items, or excessive cleaning caused during the stay by the guest or their invitees. 
  2. The Hotel may recover reasonable rectification costs and apply charges to the credit card provided or deduct from the security bond. 

10. Parking 

  1. Parking is subject to availability and posted conditions. 
  2. Vehicles are parked at the owner’s risk, except to the extent damage or loss is caused by the Hotel’s negligence. 
  3. The Hotel accepts no responsibility for loss or damage to vehicles or contents where not caused by the Hotel. 

11. Guest Property & Valuables 

  1. Guests are responsible for their personal property. 
  2. In-room safes should be used where available. 
  3. The Hotel’s liability for loss or damage to guest property is limited as permitted under applicable NSW legislation. 

12. Force Majeure 

The Hotel is not liable for failure or delay in providing accommodation due to events beyond its reasonable control, including natural disasters, severe weather, government restrictions, infrastructure failure, or utility outages. 


13. Temporary Service Disruption & Alternative Accommodation 

  1. Where accommodation or services are disrupted due to events beyond the Hotel’s reasonable control, including power outages, water damage, storm events, infrastructure failure, or essential maintenance (“Service Disruption”), the Hotel will use reasonable endeavours to minimise inconvenience. 
  2. Where a booked room is rendered uninhabitable, the Hotel may, at its discretion: 
    • relocate the guest to an alternative room within the Hotel (subject to availability); 
    • arrange alternative accommodation of a reasonably comparable standard; 
    • offer a credit for a future stay; or 
    • provide a refund for the unused portion of the accommodation, to the extent required by law. 
  3. Remedies are limited to the accommodation component of the booking and exclude consequential or indirect losses, except where required under the ACL. 
  4. Temporary interruptions to utilities or non-essential services do not constitute a major failure where accommodation remains available and safe. 

14. Utilities & Third-Party Services 

The Hotel is not responsible for disruptions caused by third-party utility providers or public infrastructure, except to the extent required by law. 


15. Emergency Access & Relocation 

The Hotel reserves the right to enter guest rooms and relocate guests where reasonably required for safety, emergency response, maintenance, or compliance with legal obligations. 


16. Privacy 

Personal information is collected and handled in accordance with Australian privacy laws. Full details are set out in the Hotel’s Privacy Policy. 


17. Limitation of Liability 

  1. Nothing in these Terms excludes rights or remedies under the ACL. 
  2. To the extent permitted by law, the Hotel is not liable for indirect or consequential loss, including loss of enjoyment, travel costs, third-party expenses, or loss of opportunity. 
  3. Subject to non-excludable rights, the Hotel’s total liability is limited to the amount paid for the accommodation component of the booking. 

18. Governing Law 

These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the jurisdiction of NSW courts and tribunals. 


19. Amendments 

The Hotel may amend these Terms from time to time. The version in effect at the time of booking applies unless otherwise required by law.
